DroneDeer Extended Protection Plan

1. Definitions

"Plan" refers to the DroneDeer Extended Protection Plan purchased from Drone Deer Recovery for a specific Eligible Product as defined in the Product Schedule (see Schedule A).

"Covered Product" refers to the specific drone unit associated with the serial number registered at the time of Plan purchase, as identified in the Product Schedule.

"Replacement Fee" refers to the fee paid by the Plan Holder at the time a claim is approved. The Replacement Fee amount is specified in the Product Schedule for each Eligible Product.

"Plan Price" refers to the one-time purchase price of the Plan. The Plan Price is specified in the Product Schedule for each Eligible Product.

"Plan Holder" refers to the original purchaser of the Plan.

"Provider" refers to HLE Drones LLC, d/b/a Drone Deer Recovery.

"Product Schedule" refers to Schedule A of this agreement, which lists all Eligible Products, their associated Plan Prices, Replacement Fees, and return requirements.

2. Eligibility & Enrollment

2.1. The Plan is available exclusively for new drones listed in the Product Schedule, purchased directly from Drone Deer Recovery.

2.2. The Plan must be purchased at the time of drone checkout or within fourteen (14) calendar days of the original drone purchase date. After this window closes, the Plan cannot be purchased.

2.3. Coverage begins immediately upon Plan purchase. There is no waiting period.

2.4. One Plan covers one (1) drone unit, identified by serial number.

2.5. The Plan is not available for replacement units received through a previous claim under this or any other DroneDeer Extended Protection Plan.

3. Coverage

3.1. The Plan covers accidental physical damage to the Covered Product, including but not limited to: crash damage, impact damage, mechanical failure resulting from a crash, water damage resulting from a crash, and damage caused by environmental conditions during flight.

3.2. The Plan provides one (1) claim during the coverage period. Once a claim is fulfilled, the Plan is fully consumed and no further coverage remains.

3.3. The coverage period is twelve (12) months from the date of Plan purchase, unless the single claim is used prior to expiration.

4. What Is Not Covered (Exclusions)

4.1. Loss or theft of the Covered Product. The damaged drone must be returned to the Provider to process a claim.

4.2. Intentional damage or abuse.

4.3. Cosmetic damage that does not affect the functionality of the drone (scratches, scuffs, dents that do not impair flight).

4.4. Damage to accessories, batteries, or peripherals purchased separately from the original drone kit, unless those items are required as part of the return (see Section 6 and the Product Schedule).

4.5. Damage occurring after the coverage period has expired.

4.6. Damage occurring more than thirty (30) days before the claim is filed.

4.7. Any drone that has been modified, including but not limited to: firmware modifications, hardware modifications, aftermarket part installations, or unauthorized third-party repairs.

5. Filing a Claim

5.1. Claims must be filed within thirty (30) calendar days of the incident that caused the damage.

5.2. To file a claim, the Plan Holder must:

• Log in to their account on the Drone Deer Recovery website

• Navigate to the original order

• Select "File a Claim"

• Provide photographs of the damage

• Provide the serial number of the damaged drone

• Submit the claim form

5.3. The Provider will review and respond to claims within two (2) business days of submission.

5.4. The Provider reserves the right to deny claims that do not meet the terms of this agreement.

5.5. If a claim is denied, the Provider will notify the Plan Holder in writing with the reason for denial. The Plan Holder may submit additional documentation or information for reconsideration within fourteen (14) calendar days of the denial notice. The Provider will review and respond to reconsideration requests within five (5) business days. The Provider's decision on reconsideration is final.

6. Return Requirements

6.1. Upon claim approval, the Plan Holder must return the items specified in the Product Schedule for their  yeah Covered Product. Missing items may delay or void the replacement.

6.2. The Provider will supply a prepaid shipping label for the return.

6.3. The Plan Holder must ship the damaged unit within fourteen (14) calendar days of receiving the prepaid shipping label. Failure to ship within this window may result in the claim being closed and the Plan forfeited with no refund.

6.4. The replacement drone will not ship until the Provider has received and inspected the damaged unit. Upon receipt and inspection, the Provider will confirm claim approval and collect the Replacement Fee. The replacement will ship once both the inspection is complete and the Replacement Fee is paid.

6.5. During inspection, if the Provider determines that the damage resulted from an excluded cause (including but not limited to modification, intentional damage, or fraud), the Provider may deny the claim and return the damaged unit to the Plan Holder at the Plan Holder's expense.

7. Replacement

7.1. Upon claim approval and receipt of the Replacement Fee, the Provider will ship a replacement drone to the Plan Holder via UPS Ground. The replacement ships the same day or next business day after inspection is complete and the Replacement Fee is paid.

7.2. The replacement drone will be a brand new or DJI factory-refurbished unit. By purchasing this Plan, the Plan Holder acknowledges and agrees that the replacement unit may be a factory-refurbished drone that has been fully inspected and restored to manufacturer specifications by DJI. Factory-refurbished units carry the same functionality and reliability as new units.

7.3. If the Provider does not have a replacement unit in stock at the time of the approved claim, the Provider will refund the Plan Holder the current retail price of the Covered Product as listed on the Drone Deer Recovery website at the time of the claim, in lieu of a physical replacement. If the Covered Product is no longer listed on the Drone Deer Recovery website, the refund amount will be the last published retail price on the website or the manufacturer's current suggested retail price, whichever is greater. This refund will be issued within five (5) business days of claim approval.

7.4. The replacement drone is not covered by a new Plan. The Extended Protection Plan is not available for replacement units.

8. Plan Limitations

8.1. The Plan is non-transferable. Only the original purchaser may file a claim.

8.2. The Plan is non-refundable. No partial or full refunds will be issued for unused Plans, including upon expiration.

8.3. The Plan does not renew. Upon expiration or claim fulfillment, no further coverage is available for that unit.

8.4. Only one (1) Plan may be active per drone at any time.

9. Voiding of Plan

9.1. The Plan is immediately void if:• The Plan Holder commits fraud or provides false information in connection with a claim

• The Covered Product has been modified (firmware, hardware, or aftermarket parts)

9.2. If the Plan is voided, no refund of the Plan Price will be issued.

10. Limitation of Liability

10.1. The Provider's maximum liability under this Plan is limited to either: (a) providing one replacement drone of the same model as the Covered Product, or (b) refunding the current retail price of the drone as described in Section 7.3 if a replacement is unavailable.

10.2. The Provider is not liable for any indirect, incidental, or consequential damages, including but not limited to: lost revenue, lost data, business interruption, or any costs associated with downtime.

10.3. The Provider is not responsible for damage or loss occurring during return shipping of the damaged unit once it has been tendered to the carrier.

10.4. The Plan Holder assumes all risk and liability associated with the operation of the replacement drone. The Provider shall not be liable for any damages, injuries, or losses arising from the Plan Holder's use of the replacement unit.

11. Governing Law & Dispute Resolution

11.1. This agreement is governed by the laws of the State of Ohio.

11.2. Any disputes arising under this agreement shall be resolved in the courts of Tuscarawas County, Ohio.

12. Force Majeure

12.1. The Provider shall not be liable for delays in fulfilling replacement obligations due to events beyond its reasonable control, including but not limited to: natural disasters, supply chain disruptions, manufacturer delays, shipping carrier disruptions, government actions, or other force majeure events. In such cases, the Provider will fulfill its obligations as soon as reasonably practicable and will communicate expected timelines to the Plan Holder.

13. General Provisions

13.1. Entire Agreement. This agreement, including the Product Schedule, constitutes the entire agreement between the Plan Holder and the Provider regarding the Extended Protection Plan and supersedes all prior communications, representations, or agreements, whether written or oral.

13.2. Severability. If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

13.3. Waiver. The Provider's failure to enforce any provision of this agreement shall not constitute a waiver of that provision or the right to enforce it at a later time.

13.4. Amendments. The Provider reserves the right to update these terms at any time. Changes will not apply retroactively to Plans already purchased. The terms in effect at the time of Plan purchase will govern that Plan for its full coverage period.
